Al-IjmāʿIbn al-Mundhir

— They unanimously agree that if a man says to his wife, “When you menstruate you are divorced,” then once she sees the blood the divorce takes effect.

— They unanimously agree that if he says, “If you experience one menstrual period you are divorced,” she is not divorced until she has become pure from that period; once she attains purity, the divorce becomes effective. Mālik ibn Anas alone dissented, holding that the oath is considered broken from the moment he utters it.

— They unanimously agree that when a man has pronounced a triple divorce upon his wife and, after that pronouncement, has sexual intercourse with her, and reliable testimony establishes that he did indeed pronounce the divorce while he denies it, separation between them must be enforced and no ḥadd punishment is imposed on the man.

— They unanimously agree that the divorce pronounced by a prodigal or legally incompetent person (safīh) is binding upon him (1). ʿAṭāʾ ibn Abī Rabāḥ alone dissented, saying that neither his marriage nor his divorce is valid.

— They unanimously agree that when a man divorces his wife three times, she is not lawful for him until she has married another husband (2), as stated in the ḥadīth of the Prophet (peace and blessings be upon him). Saʿīd ibn al-Musayyib alone dissented, maintaining that if her subsequent marriage is valid and is not undertaken merely to make her lawful for the first husband, then the first husband may lawfully remarry her.

— They unanimously agree that if the woman says to her first husband, “I have married another man and he has consummated the marriage with me,” and he believes her, she thereby becomes lawful for him.

— They unanimously agree that if a free man divorces a free woman three times, her waiting period expires, she marries another husband who consummates the marriage, he then divorces her, her second waiting period ends, and she subsequently remarries her first husband, she returns to him with a full entitlement to three further divorces.

— They unanimously agree that if a man says to his wife, “You are divorced three times except for one,” she is deemed divorced twice.
