249 – They unanimously agree that a minor’s safety pledge is invalid (1).

(1) The validity of a minor’s grant of safe-conduct (aman) was affirmed by Muhammad al-Shaybani among the Hanafis, as reported in al-Mabsut (10/72), and by Ibn al-Qasim among the Malikis, as cited in al-Mudawwana (1/525).
Dirar al-Hukkam, commentary on Ghurar al-Ahkam (1/285), states: “If the minor has been authorised to fight, the soundest view—accepted by consensus—is that his aman is valid.”
Al-Mardawi writes in al-Insaf (4/203–204): “With regard to the discerning minor’s aman there are two transmitted opinions. The first, which is the authoritative position, holds that it is valid … Abu Bakr maintained its validity without exception, interpreting the contrary report as applying to a non-discerning child; this is also the implication of the views of his teacher and of al-Zarkashi. The second opinion rules it invalid, a possibility suggested by al-Khirqi’s wording.”
Al-Fatawa al-Hindiyya (2/198) likewise records: “If the minor has been permitted to participate in combat, the soundest opinion among our scholars—the Hanafis—is that his aman is valid, as stated in Fath al-Qadir.”
