Al-IjmāʿIbn al-Mundhir

182 – They unanimously agree that any pilgrim arriving from outside the Ḥaram who enters into iḥrām for ʿumrah during the months of Hajj, completes that ʿumrah in Mecca, then remains there and performs Hajj in the same year, is deemed a mutamattiʿ; a sacrificial animal (hady) is incumbent upon him if he can afford it, otherwise he must fast.

183 – They unanimously agree that whoever enters Mecca for ʿumrah during the months of Hajj may incorporate Hajj into it, as long as he has not yet begun the circumambulation of the Kaʿbah.

184 – They unanimously agree that no liability rests upon the person who spends the night before ʿArafah away from Mina, provided he reaches ʿArafah at the obligatory time.

185 – They unanimously agree that the pilgrims may camp in Mina wherever they wish.

186 – They unanimously agree that on the day of ʿArafah the imam combines the Zuhr and ʿAṣr prayers at ʿArafah, and the same applies to anyone praying alone.

187 – They unanimously agree that standing at ʿArafah is a pillar of Hajj; whoever misses it has no Hajj.

188 – They unanimously agree that whoever stands at ʿArafah—by night or by day—any time after the sun has passed its zenith on the day of ʿArafah has secured the Hajj. Mālik alone held that he must repeat the Hajj the following year (1).

(1) Al-Hattab, Mawahib al-Jalil, 3/94: “From the author’s wording it is understood that whoever stands at Arafah during the day but not at night, his standing is not valid; this is Malik’s position.” – Al-‘Adawi, marginalia on Sharh Kifayat al-Talib al-Rabbani, 1/539: “The essential (obligatory) standing is to remain there for some part of the night after sunset.” – Al-Dusuqi, gloss on al-Sharh al-Kabir, 2/37: “Ibn ‘Abd al-Salam summarizes: the time allotted for the standing is broad, its last limit being dawn. Scholars differ about its beginning: the majority say it starts after the Zuhr prayer, while Malik holds that it begins at sunset. The majority view is shared by al-Lakhmi and Ibn al-‘Arabi, and it is also inclined to by Ibn ‘Abd al-Barr.”
