73 – The scholars unanimously agree that what a man is required to cover in prayer is his front and back private parts.
74 – They unanimously agree that a free, adult woman must veil her head when she prays, and that if she prays while her entire head is uncovered she must repeat the prayer.
75 – They unanimously agree that a female slave is not obliged to cover her head, though al-Hasan held a solitary opinion making it obligatory for her (1).
Chapter on Witr
76 – They unanimously agree that the time for the witr prayer extends from the Night Prayer (2) until dawn breaks.
77 – They unanimously agree that the prostration attached to the first verse of prostration in Surah al-Hajj is established (3).
(1) Al-Nawawi states in al-Majmuʿ (3/171): “Our colleagues report from Malik that the umm al-walad (a slave-woman who has borne her master a child) is treated like a free woman with respect to prayer; and from al-Hasan al-Basri that, once she has given birth, she is like a free woman in all respects.”
(2) The Q copy (fol. 958) adds the word: [al-akhira] (the latter).
(3) Ibn Hubayra (1/181) writes: “The jurists concur that the prostration of recitation (sujud al-tilawa) is not obligatory, except for Abu Hanifa, who made it mandatory for both the reciter and the listener, whether the listener intended to listen or not.” He also says: “They agree that Surah al-Hajj contains two prostration verses, except Abu Hanifa and Malik, who recognize only the first.” The unanimous agreement on the first prostration in al-Hajj is likewise reported by Ibn ʿAbd al-Barr in al-Tamhid (19/130).
Ibn Hazm states in Maratib al-Ijmaʿ (p. 57): “The scholars agree that the Quran contains no more than fifteen prostration verses; they concur on ten of them and differ over the one in Surah Sad, the second in Surah al-Hajj, and the three located in the mufassal section.”
