is impermissible. (1) One of them—and it is forbidden. (1)

488 — They unanimously agree that if the two parties exchanging currency separate before each has taken possession, the exchange is invalid.

489 — They unanimously agree that the master may reclaim whatever is in the slave’s hand; he may take two dinars from him and hand him one dinar.

490 — They unanimously agree that any edible or drinkable commodity sold by measure or weight falls under the same ruling that the Messenger of Allah ﷺ forbade. Qatadah alone dissented, declaring it permissible.

491 — They unanimously agree that selling one heap of a foodstuff for another heap of the same kind is not permissible.

492 — They unanimously agree that such a sale is permissible when the two heaps are of different kinds.

493 — They unanimously agree that selling dried dates for fresh dates is impermissible. Al-Nuʿman (Abu Hanifah) alone differed and allowed it.

494 — They unanimously agree that if a man purchases a female slave who turns out to be married and the buyer was unaware of this, that is a defect that entitles him to return her.

495 — They unanimously agree that a valid salam (forward sale) is where one party pays the other in advance for a specified and described quantity of food—of a type commonly available in the land, such that its like is not normally lacking—measured by a known volume or weight, for a fixed term; the price is to be paid in identified dinars or dirhams before the two parties separate from the place of contract, and they must specify the place where the food will be received. If they do all of that, and both are legally competent, the contract is sound. (2)

(1) This point is confirmed by the hadith of Ubadah ibn al-Samit, recorded by Muslim (no. 1587): the Messenger of Allah ﷺ said, “Gold for gold, silver for silver, wheat for wheat, barley for barley, dates for dates, and salt for salt—like for like, equal for equal, hand to hand. If the categories differ, then sell as you wish, provided it is hand to hand.” (2) It is likewise affirmed in the hadith of Ibn Abbas, recorded by al-Bukhari (no. 2241) and Muslim (no. 1604).
