487 — They unanimously agree that exchanging any of the six commodities in unequal amounts—whether hand-to-hand or on credit—is impermissible. (1)
= The isnad transmitted by Husayn ibn Musa, from Ibn Luhayʿa, from Huyayy ibn ʿAbd Allah al-Maʿafari, from Abu ʿAbd al-Rahman, ending with the same wording—although he adds an introductory anecdote.
I add: al-Tirmidhi judged the report “hasan gharib,” while al-Hakim ruled, “sound according to Muslim’s criteria, though the two Shaykhs did not include it.” Al-Zaylaʿi, in Nasb al-rayah (4/23), comments on al-Hakim’s ruling: “This requires reconsideration, for nothing from Huyayy ibn ʿAbd Allah appears in the Sahih, and a number of critics spoke against him. Ibn al-Qattan cites al-Bukhari as saying, ‘There is some reservation about him’; Ahmad said, ‘His hadiths are munkar’; Ibn Maʿin said, ‘There is no harm in him’; al-Nasaʾi said, ‘He is not strong.’ Because of this divergence al-Tirmidhi did not declare the hadith sahih.”
I add: In al-Darimi’s recension he is followed by ʿAbd al-Rahman ibn Junadah, for whom I have found no biographical notice.
Al-Bayhaqi, in Shuʿab al-iman (7/484), also records the hadith through Baqiyyah, who said, “Khalid ibn Humayd narrated to us from al-ʿAlaʾ ibn Kathir from Abu Ayyub al-Ansari,” raising it to the Prophet. I note: Baqiyyah practises tadlis al-taswiyah and explicitly mentions hearing only from his own shaykh. Ibn ʿAbd al-Hadi, in Tanqih Tahrir Ahadith al-Taʿliq (2/587) after citing al-Bayhaqi, remarks: “In its chain is al-ʿAlaʾ—the Alexandrian—who is saduq, but he did not hear from Abu Ayyub, so the isnad is broken.”
A supporting report exists in al-Hakim’s al-Mustadrak (2/63) through Abu Bakr ʿAyyash, from Sulayman al-Taymi, from Taliq ibn Muhammad, from ʿImran ibn Husayn: the Messenger of Allah ﷺ said, “Cursed is the one who separates a mother from her child.” Yet the transmission from Taliq is disputed: Ismaʿil ibn Mujammaʿ relates it from him, from Abu Burdah, from Abu Musa, who said: “The Messenger of Allah ﷺ cursed whoever separates a mother from her child and a brother from his brother.” This version is found in al-Darqutni (3/67). Saʿid ibn Mansur, in his Sunan (2/290), narrates it via Hushaym, from Sulayman al-Taymi, from Taliq as a mursal report. Two narrators corroborate Abu Bakr ʿAyyash’s wording: ʿAbbad ibn ʿAwwam in al-Tabarani’s al-Duʿaʾ (2114) and Zuhayr ibn Muʿawiyah in Tamam al-Razi’s al-Fawaʾid (2/41).
Al-Darqutni, in the ʿIlal (7/217), judged the version of al-Taymi from Taliq to be mursal. Ibn al-Qattan—after quoting ʿAbd al-Haqq’s discussion in his Ahkam on the variants from Taliq—concludes: “In short, the hadith is not sound because Taliq’s reliability is unknown; he was a Khuzaʿi” (Nasb al-rayah 4/25).
