from his religion—just as the polytheists used to persecute anyone who embraced Islam in order to make him turn back from his faith 1. For that reason the Exalted said, “Persecution is worse than killing.” This only occurs when they assault the Muslims and wield authority over them; at that point fighting them becomes obligatory 2 so that there will be no persecution, so that they will not be able to put a Muslim to trial. This objective is achieved by rendering them incapable of fighting, and did not
(1) Shaykh al-Islam writes in al-Sarim al-Maslul, 2/514–515: “The aim of fighting is that the word of Allah should be uppermost, that the entire religion belong to Allah, and that there be no fitna (religious persecution)—meaning that no one should coerce another away from the religion of Allah. Fighting therefore targets only those who oppose this aim, namely the combatants. As for those who do not fight—women, the very old, monks, and the like—there is no basis for killing them.”
(2) I add: When the Muslim community formed a single polity with one ruler under whose banner it fought, this obligation fell upon all Muslims without exception. In our own era, however, authority is split among several states, each with its own head of government and legal order. The duty therefore becomes an individual obligation (fard ‘ayn) for the inhabitants of any land that is attacked; none of them has an excuse to shirk it. For Muslims outside that land, it remains obligatory but on a collective basis (fard kifaya), provided that participation does not lead to a manifest, tangible harm. Should such harm be expected, the ruler may adopt whichever course best serves Islam and the Muslims.
