Section on Fighting the Disbelievers
Is the reason for engaging them in battle their own belligerence, or is it simply their kufr (disbelief)?
On this matter the scholars hold two famous opinions:
First: the position of the majority—Malik, Ahmad ibn Hanbal, Abu Hanifah, and others (1).
(1) Shaykh al-Islam said in al-Fatawa (20/101–102): “Abu Hanifa maintained that unbelief (kufr) in itself does not warrant fighting a person unless he is actively waging war; whoever does not engage in hostilities is not to be fought. Hence he would accept the jizya from Arab idolaters who were not People of the Book. Malik and, in one of the two transmissions, Ahmad concurred with him on this … By contrast, al-Shafi‘i held that mere disbelief makes a person’s blood licit, except that women and children are spared because they are regarded as booty for the Muslims.”
He also said in al-Fatawa (8/534) and al-Fatawa al-Kubra (4/347): “The apostate (murtadd) is to be executed even if he is incapable of fighting, unlike the original unbeliever who does not belong to the people of combat; such a person is not put to death according to most scholars, including Abu Hanifa, Malik, and Ahmad.”
He further stated in al-Fatawa (28/659–660): “Concerning monks … the scholars differed about killing them, just as they disagreed regarding those who cause no harm to Muslims by hand or tongue, such as the blind, the crippled, the very old, and similarly women.”
