Qāʿidah fī Qitāl al-KuffārIbn Taimiya

He also said (1): “An original disbeliever who is not among the fighting folk is not to be killed, according to most scholars, such as Abu Hanifah, Malik, and Ahmad.”

He further stated (2): “With regard to the original disbeliever … none of them may be killed except those who are combatants, according to the majority of scholars, as the Sunnah indicates.”

Shaykh al-Islam has examined this matter in our present brief treatise with precise detail, clarifying that it is impermissible to kill a disbeliever merely on account of his disbelief. He supported this with evidence from the Quran, the Sunnah, and sound reasoning, and he showed that this is the position of the majority of scholars, including Abu Hanifah, Malik, and Ahmad.
