Qāʿidah fī Qitāl al-KuffārIbn Taimiya

to be asked to repent. This threefold categorization is found in the legal schools of Mālik, Aḥmad, and others, and it is discussed at length in Al-Sarim al-Maslūl ʿalā Shātim al-Rasūl (1). The same applies to outright unbelief.

(1) See (3/696, 866). In the first passage he writes: “Ridda (apostasy) is of two kinds: simple apostasy and aggravated apostasy, for which the law specifically prescribes execution. Proofs establish the obligation to execute the perpetrator in both cases. The texts that speak of execution being waived upon repentance do not cover both kinds; they apply only to the first, as is clear to anyone who studies the evidence for accepting the repentance of the apostate. Thus the second kind remains: the obligation to execute its perpetrator is proven, and neither text nor consensus removes this penalty, while analogy fails because of the obvious distinction between the two. What confirms this approach is that nowhere in the Quran, the sunnah, or the scholarly consensus is it stated that every apostate—whatever words he utters or deeds he commits—escapes execution if he repents after being apprehended; rather, the Quran, the sunnah, and consensus differentiate between categories of apostates.”
