Qāʿidah fī Qitāl al-KuffārIbn Taimiya

Were unbelief itself what made execution obligatory, every captive disbeliever would have had to be put to death. Yet the Prophet granted pardon to Abu ‘Azza al-Jumahi, to Thumamah ibn Athal, and to others besides them.

If it is said, “Granting pardon and accepting ransom have been abrogated,”

…“He was deemed a combatant by the majority of scholars, as established by the Sunnah.” He also states, at the same place (28/355): “For this reason the sharia has made fighting the unbelievers obligatory, yet it has not made killing every captive among them obligatory. If one of them is taken prisoner—whether during battle or outside it, for example when a ship casts him upon us, he loses his way, or he is captured by stratagem—the ruler must adopt the course most beneficial: execution, enslavement, release without compensation, or exchange for wealth or for another person, according to most jurists, as indicated by the Quran and the Sunnah, even though some jurists hold that release or ransom has been abrogated.” He further says in the same work (34/116): “When the imam is allowed to choose, in the case of prisoners, between execution, enslavement, pardon, and ransom, he is obliged to select what best serves the interests of the Muslims.” And in Minhaj al-Sunnah (4/422) he writes: “Ijtihad requires that the wali al-amr (supreme authority) or his deputy, when presented with two or more permissible options, chooses on the basis of what is most beneficial, not on the basis of personal desire—just as, according to most scholars, the imam may choose for the prisoners between execution, enslavement, pardon, and ransom.”
