[The Ruling When Unbelievers Break Their Treaty]
Then, if a group makes a treaty with the Muslims and later violates it, the Muslims are under no obligation to renew that treaty. Rather, they are entitled to fight them—even should the violators request to pay the jizya. The imam may lawfully put them to death until they accept Islam, or, if he deems it in the public interest, expel them from the territories of Islam. ⦗1⦘
— whether hypocrite, righteous, wicked, benefactor, wrong-doer, or any of the other designations found in the Qur’an and the hadith; nowhere do these sources assign the Arabs any special legal status.
(1) Shaykh al-Islam Ibn Taymiyya, Majmuʿ al-Fatawa 19/23: “The Prophet never levied jizya on the Jews of Madina or Khaybar. He fought them before the verse on jizya was revealed, and later allowed the Jews of Khaybar to remain as tenant-farmers, without jizya, until ʿUmar expelled them. They were under a truce with him and cultivated the land; he kept them because the Muslims needed their labour. Shortly before his death he ordered their expulsion and commanded that both Jews and Christians be removed from the Arabian Peninsula. Some scholars restrict this ruling to the Peninsula, while others—including Ibn Jarir—hold it to be general: wherever Muslims can dispense with the People of the Pact, they must expel them from the lands of Islam.”
