“treat them as you treat the People of the Book.” (1)
This hadith’s isnad is broken: Jaʿfar narrated it from his father, who in turn narrated from ʿAbd al-Rahman, yet his father never met ʿAbd al-Rahman. Even if we grant that its wording is sound, it (2) still indicates that they are not People of the Book; rather, the intended meaning is only that jizya be taken from them
(1) Recorded by `Abd al-Razzaq (6/68), Ibn Abi Shayba (12/243), Malik (1/278), al-Bazzar (3/264), Abu Ya`la (2/168), al-Shashi (1/288), al-Daraqutni (4/299), and al-Bayhaqi in al-Sunan al-kubra (9/189), all through various chains ending with `Abd al-Rahman ibn `Awf. The chain is interrupted (munqati`). Al-Daraqutni comments in his `Ilal (4/299): “The report is transmitted by Ja`far ibn Muhammad, but the narrators differ about it. Malik relates it through Abu `Ali `Ubayd Allah ibn `Abd al-Majid al-Hanafi, from Ja`far ibn Muhammad, from his father, from his grandfather, from `Ali ibn al-Husayn. Malik’s companions, however, do not mention ‘from his grandfather’. The same version is given by al-Thawri, Sulayman ibn Bilal, `Abd Allah ibn Idris, Hafs ibn Ghiyath, Anas ibn `Ayyad, and Abu `Asim al-Nabil—who heard nothing else from Ja`far ibn Muhammad—as well as by `Abd al-Wahhab al-Thaqafi, al-Qasim ibn Ma`n, Ibn Jurayj, `Ali ibn Ghurab and others: all narrate it from Ja`far, from his father, as a mursal report from `Abd al-Rahman ibn `Awf, without mentioning `Ali ibn al-Husayn. That is the correct version.”
(2) The printed edition reads the single letter “dal (d).”
