Qāʿidah fī Qitāl al-KuffārIbn Taimiya

As for binding covenants, is it permissible to rescind them merely out of fear of treachery? There are two opinions on the matter, and the more persuasive is that it is not permissible (1), for Surah Bara’ah obliges faithfulness to them (2).

(1) Shaykh al-Islam writes in al-Fatawa al-Kubra, vol. 4, p. 613: “Chapter on the *hudna* (armistice): it may be concluded either without a term or for a fixed period. A fixed-term treaty is binding on both parties and must be honoured unless the enemy breaks it; according to the stronger of the two scholarly views, it is not annulled merely by a fear of treachery. An open-ended treaty, however, is revocable, and the ruler decides according to what best serves the public interest.” (2) Ibn al-Qayyim states in Ahkam Ahl al-Dhima, vol. 2, p. 892: “Since the people under treaty (*mu‘ahidun*) comprise both categories, and Allah has ordered us to repudiate a pact that is not binding and to uphold one that is, this affirms the Qur’an’s teaching, confirmed by the Sunnah, the principles of the Sharia, and the interests of Islam. Allah’s help is sought.”
