Qāʿidah fī Qitāl al-KuffārIbn Taimiya

The fifth proof for the prohibition of fighting disbelievers who do not fight

He then said: “A captive slave is not to be forced into Islam by unanimous agreement (1). And if it is impermissible to let idolaters remain under the payment of jizya, then—regarding the permissibility of enslaving them—there are two opinions, both reported from Ahmad (2). Furthermore, the Prophet ﷺ and the believers with him used to take men and women prisoner from…”

(1) Shaykh al-Islam says in al-Fatawa, 31/381: “The Companions enslaved them (*istirqaq*), and we have no report that they compelled them to embrace Islam. Because it is not permissible to kill them, they must therefore be kept as slaves.” (2) Shaykh al-Islam continues in the same work, 31/382: “There are two opinions on whether it is lawful to enslave those from whom the poll-tax (*jizya*) is not accepted; both opinions are transmitted from Ahmad ibn Hanbal. – First opinion: Enslavement is like taking the *jizya*; therefore, if the *jizya* is not taken from a people, they are not to be enslaved. This is the position of Abu Hanifa and others. It was preferred by al-Khiraqi, al-Qadi and other Hanbalis, and by al-Istakhri among the Shafiʿis. – Second opinion: It is permissible to enslave idol-worshippers (*ahl al-awthan*) from whom the *jizya* is not taken. This is the view of al-Shafiʿi and the other narration from Ahmad. … Slavery imposes a heavier burden than the payment of *jizya*. From what we have stated, the sound view is that it is permissible to enslave the Arabs.”
