Furthermore, the Sunan collections relate from Anas that the Prophet—peace and blessings be upon him—said: “Set out in the name of Allah, by Allah, and upon the creed of the Messenger of Allah. Do not kill an aged, frail elder, nor a child, nor any minor, nor a woman. Do not act treacherously, gather your spoils together, make amends, and do good—for Allah loves those who excel in goodness.”⦗2⦘ This ḥadīth was narrated by Abū Dāwūd.

(1) Shaykh al-Islam Ibn Taymiyya writes in al-Sarim al-Maslul 2/207: “Anyone who is not a combatant may not be fought.” Ibn Hibban states in al-Ihsan 11/109: “Because the effective cause I have explained is sound, it shows that if children or women in enemy territory take part in fighting, they may themselves be fought, for the reason that exempted them from being killed—their abstention from combat—no longer exists in their case.” (2) Reported by Abu Dawud, Sunan, no. 2614; likewise by al-Bayhaqi, Sunan 9/90; Ibn Abd al-Barr, al-Tamhid 24/233; and Tamam, Fawaʾid 1/90.
