– Whoever is unable to procure an animal for the uḍḥiyah or the ʿaqīqah should take a loan, offer the uḍḥiyah, and perform the ʿaqīqah even though he presently has no ability to repay (1). ⦗Ikhtiyārāt al-Baʿlī p. 178⦘.
– Because the uḍḥiyah counts as part of customary household spending, the guardian should sacrifice on behalf of an orphan from the orphan’s own funds (2); a wife may take from her husband’s wealth what she needs to slaughter for the household even without his permission; a debtor may slaughter so long as he is not being pressed to settle his debt; and whoever expects to be able to repay may purchase on credit and slaughter as well. ⦗Majmūʿ al-Fatāwā 26/306; Ikhtiyārāt al-Baʿlī p. 178⦘.
– If one forms the intention when buying the animal, the hady or uḍḥiyah does not thereby become designated; this is the official view of the school and the position of its leading scholars. Another report holds that it is designated by purchase coupled with intention; this was the opinion chosen by Shaykh Taqī al-Dīn, as mentioned in al-Fāʾiq. ⦗al-Inṣāf 4/89⦘.
– Transfer of ownership is not a condition in the ʿaqīqah. ⦗al-Furūʿ 6/113; Ikhtiyārāt al-Baʿlī p. 178⦘.
