eat from it, provided he neither carries any away nor pelts the trees with stones.
Hospitality is obligatory for a Muslim traveler who passes through a village for one day and one night; if the residents refuse, he may seize what suffices for that period by force.
Section
On Ritual Slaughter
No animal that one is able to seize becomes lawful without proper slaughter, except locusts and creatures that survive only in water.
The following conditions (1) must be met:
-
Competence of the slaughterer: he must be of sound mind and either a Muslim or a scripturalist (Jew or Christian)—even if he is a discerning minor, a woman, uncircumcised, or blind. This excludes the drunkard, the apostate, and the like.
-
The instrument: any sharp edge—even if wrongfully taken—whether of iron, stone, reed, or the like, so long as it is not a tooth or a claw.
-
Severing the trachea and the esophagus; cutting the two jugular veins (2) is not obligatory.
As for an animal that cannot be controlled, or one that has fallen into a well and the like, he may stab it (3) wherever he can reach, unless its head is under water.
