If he tells her, “Should you give me one thousand, you are divorced,” then the divorce takes effect on that basis, even if the payment is delayed. Should she say, “Release me by khulʿ—or divorce me—for one thousand,” and he complies, the separation is irrevocable and he is entitled to the sum. If she stipulates, “Divorce me once for one thousand,” but he pronounces three divorces, he still deserves the payment; the opposite is not true—unless no further divorces remained ⦗1⦘.
A father has no authority to arrange a khulʿ or pronounce a divorce on behalf of his minor son’s wife, nor may he conclude a khulʿ for his minor daughter using any part of her property. Khulʿ, like other forms of separation, does not waive any of the spouses’ financial rights. The same rule concerning conditional clauses applies in matters of manumission and divorce.
