provided the man is merely castrated or impotent; she may, however, be prevented from marrying one who is insane, leprous, or afflicted with vitiligo. Whether she knew of the defect when the contract was concluded or it appeared later, she cannot be compelled to seek annulment.

Chapter
[Marriage among Non-Muslims]

The marriage contracts of non-Muslims are treated like those of Muslims with respect to all the rights they establish—dowry, divorce, and the like. They are left in place even when invalid according to our law, so long as the couple regard them as lawful and do not submit the case to us. If they come to us before the contract is concluded, we solemnize it according to our rulings; if they come after the contract, or both spouses subsequently embrace Islam, then if the union is lawful it is confirmed, otherwise the two are separated.

If a man and woman from belligerent non-Muslim territory have intercourse thinking it a marriage, they are likewise left as they are. Whenever the dowry they stipulated is valid she receives it; but if the stipulation is invalid, or the dowry was not specified or not yet received, she is entitled to the customary dowry of her peers.

If both spouses accept Islam together, or if the husband of a Jewish or Christian woman does so, the marriage remains intact. Should she embrace Islam—or one member of a non-Scriptural couple do so—before consummation, the marriage is void, and if he preceded her she is entitled to half the dowry. After consummation, the matter is suspended until her waiting period ends: if the other spouse embraces Islam during that period, the marriage stands; otherwise it is deemed annulled from the moment the first spouse became Muslim. If both of them, or one of them, apostasize before consummation, the marriage is dissolved; if apostasy occurs after consummation, the union is likewise suspended until the waiting period is over.
