Tawḍīḥ al-AḥkāmAbd Allah al-Bassam
  • Points derived from the ḥadīth:
    1 – The ḥadīth indicates that whoever vows to perform Hajj or ʿUmrah on foot is not obliged to fulfil the vow exactly as stated; he may walk as much as he is able, ride whenever he wishes, and must then offer the expiation for breaking an oath (kaffārat yamīn).
    2 – Vows that impose hardship in acts of worship are disliked, and once such a vow is made it is not binding. According to Imām Aḥmad, the person must give the expiation for an oath because he did not carry out his vow, whereas the other three Imāms hold that no expiation is required.
    3 – In the version recorded by Aḥmad (2824) and Abū Dāwūd (3295) the wording is: “and let her make expiation for her oath,” while the wording in this chapter says: “and let her fast three days.” Aḥmad also transmits: “and let her offer a budnah (a sacrificial camel),” but al-Bukhārī ruled that the report about the sacrificial animal (hady) is not sound, and the authentic narrations do not prescribe an expiation for a vow that is not an act of obedience.
    4 – As for the expiation of oaths, Allah the Exalted says: “Allah will not call you to account for idle oaths, but He will call you to account for oaths you have sworn in earnest; the expiation for such is to feed ten needy people from what you normally feed your own families, or clothe them, or free a slave. Whoever cannot find the means must fast three days. That is the expiation for your oaths when you have sworn.” [al-Māʾidah 5:89]
    Drawing on this verse, Sharḥ al-Iqnāʿ and other works state that the person liable for the expiation may choose one of three options:
    – feeding ten needy persons;
    – clothing ten needy persons; or
    – freeing a believing slave.
    If he is unable to free, feed, or clothe, then he must fast three days. He may not resort to fasting unless he is genuinely incapable of one of the other three options, as the verse stipulates.
    5 – Sharḥ al-Iqnāʿ also states that it is permissible to feed some of the ten and clothe the rest. The expiation for an oath or a broken vow must be discharged immediately once the person violates it, for immediacy is the default ruling in an unqualified command.
* ما يؤخذ من الحديث: ١ - يدل الحديث على أنَّ من نذر الحج أو العمرة ماشيًا أنَّه لا يلزمه الوفاء بنذره، وإنَّما له أنْ يمشي طاقته، ويركب ما شاء، وأنَّ عليه كفَّارة يمين. ٢ - أنَّ النَّذر فيما يشق على العبد من الأعمال والطاعات مكروه، وإذا وقع من العبد فلا يلزم به، ومذهب الإِمام أحمد: أنَّ على النَّاذر كفَّارة يمين؛ لعدم الوفاء بنذره، ومذهب الأئمة الثلاثة: أنه لا يجب عليه كفَّارة. ٣ - جاء في رواية أحمد (٢٨٢٤) وأبي داود (٣٢٩٥) من هذا الحديث: "ولتكفِّر عن يمينها"، ورواية الباب: "ولتصم ثلاثة أيَّام"، ولأحمد أيضًا: "ولتهد بدنة"، لكن قال البخاري: لا يصح الهدي، ولم يجىء في الأحاديث الصحيحة كفَّارة لما ليس بطاعة. ٤ - أما كفَّارة اليمين، فقال تعالى: ﴿لَا يُؤَاخِذُكُمُ اللَّهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ وَلَكِنْ يُؤَاخِذُكُمْ بِمَا عَقَّدْتُمُ الْأَيْمَانَ فَكَفَّارَتُهُ إِطْعَامُ عَشَرَةِ مَسَاكِينَ مِنْ أَوْسَطِ مَا تُطْعِمُونَ أَهْلِيكُمْ أَوْ كِسْوَتُهُمْ أَوْ تَحْرِيرُ رَقَبَةٍ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ ذَلِكَ كَفَّارَةُ أَيْمَانِكُمْ إِذَا حَلَفْتُمْ﴾ [المائدة: ٨٩]: قال في شرح الإقناع وغيره مستدلين بهذه الآية: يخير من لزمته الكفارة بين ثلاثة أشياء: - إطعام عشرة مساكين. - كسوة عشرة مساكين. - تحرير رقبة مؤمنة. فإنْ لم يجد بأنْ عجز عن العتق، والإطعام، والكسوة، فصيام ثلاثة أيَّام، ولا ينتقل المكفِّر إلى الصوم إلاَّ إذا عجز؛ للآية. ٥ - قال في شرح الإقناع: ويجوز أنْ يطعم بعضًا من العشرة، ويكسو بعضًا منهم. وتجب كفَّارة يمين ونذر على الفور إذا حنث، لأنَّهُ الأصل في الأمر المطلق.
