Points derived from the hadith
- For an animal to be lawful to eat, it must be slaughtered or sacrificed and the blood must flow from the point of slaughter or sacrifice. This is achieved by severing the trachea (ḥalqūm) and the esophagus (marīʾ).
- The instrument of slaughter must be sharp so that the animal is killed by the blade itself, whether the blade is made of iron, wood, stone, or anything else. A tool that kills by its weight or blunt force does not render the meat lawful.
- Two implements are excluded from the class of sharp tools: the tooth and every kind of bone, as well as the fingernail. Even though they may cut, it is impermissible to slaughter with them, and any animal slaughtered in this manner is not lawful to eat.
- As for the fingernail, it is the “knife” of the Abyssinians, who slaughter with it. Imitating them is not permitted, and using it also resembles predatory beasts that tear their prey with claws, and birds of prey that seize with talons.
- The same ruling that applies to the tooth applies to all other bones: slaughtering with them is forbidden and the meat is unlawful. Allah knows best, but this is in order to avoid resembling carnivores that rend with their fangs. As for other bones, if they come from a carrion or an impure animal, the prohibition is due to their impurity; if they are pure, then because they must not be exposed to impurity—namely, the spilled blood. Bones have also been prohibited for istinjāʾ (ritual cleansing) lest they become defiled, for they are the food of our brothers among the jinn, as stated in a sound hadith. Moreover, the Prophet ﷺ explained the prohibition of slaughtering with a tooth by saying that the tooth is a bone.
- The neck contains four passages: the trachea, which is the airway; immediately behind it the esophagus, the passage for food and drink; and on either side of the neck the two jugular veins, which are vessels through which
