Tawḍīḥ al-AḥkāmAbd Allah al-Bassam

He further writes in al-Muntahā: “It is unlawful to slaughter an animal that is not fit for consumption simply to spare it the pain of illness or the like. What is incumbent upon us is to look after it, providing the feed, fodder and other necessities it requires.”

  1. The ḥadith also indicates that eating an animal subjected to al-ṣabr (being restrained and left to die) is forbidden. Had that method constituted a valid slaughter that renders the meat lawful, the Prophet ﷺ would not have prohibited it.

Al-Iqnāʿ and its commentary state: “Neither the animal subjected to al-ṣabr nor the one killed by strangulation may be eaten.” Saʿīd narrated: “The Messenger of Allah ﷺ forbade the strangled animal (al-munkhanīqah) and the eating of an animal subjected to al-ṣabr.” Strangulation occurs only with birds, hares and the like, whereas al-muṣbarah applies to any creature that is confined until it is killed.
