Tawḍīḥ al-AḥkāmAbd Allah al-Bassam

– The humblest of them: the fewest in number—down to a single person—and the lowest in rank, namely the weak among the common folk such as a woman or a hired servant.
– The Muslims’ dhimmah: the pact, guarantee of safety, and surety; so called because breaking it incurs blame.
– The most distant of them: the one farthest removed in terms of worldly circumstances.

Lessons derived from the ḥadīth:

  1. As noted in the introduction, a specific pledge of security for an individual, a clan, a caravan, or a small fortress is valid when issued by any member of the Muslim community.
  2. The ḥadīth indicates that some Muslims may grant protection to unbelievers and that their pledge is binding upon all Muslims; it is therefore unlawful to violate or reject it.
  3. Granting and enforcing safe-conduct is permissible whether it is general—issued by the imam—or particular—issued by a governor or by a private individual—so long as it causes no harm to the Muslims. If it entails harm, the contract is invalid, for the welfare of the Muslims must be safeguarded.
  4. The various chains of this ḥadīth show that a single Muslim may conclude a covenant of protection, whether male or female, free or enslaved; this is the position of the majority of scholars.
  5. Jurists differ over the validity of a guarantee given by a woman, a slave, or a pubescent minor. The majority hold it to be sound and binding, relying on the general wording of the authentic reports that state, “the humblest of them may grant it.”
  6. Anyone who seeks protection in order to listen to the word of Allah and to learn the ordinances of Islam must be granted it and then escorted to a place of safety, as in the verse: “And if anyone of the polytheists seeks your protection, grant him asylum so that he may hear the word of Allah; then convey him to a place of safety” (At-Tawbah 9:6). Al-Awzāʿī said: “The ruling of this verse remains in force until the Day of Resurrection.”
  7. One narration states: “The believers are a single hand against others; the least of them may grant protection…"
