- Points derived from the ḥadith
These are selected observations of Ibn al-Qayyim—may Allah have mercy on him—regarding the abomination of sodomy:
-
The harm caused by sodomy ranks among the gravest of all harms; among sins nothing is more ruinous except disbelief, and it may even be more ruinous than murder.
-
Before the people of Lot, Allah had never afflicted any nation on earth with this enormous sin. He says, “None among the worlds has ever committed such an outrage before you” (al-Aʿrāf 7:80). He then punished them with a chastisement He inflicted on no one else: “When Our decree came, We turned their town upside-down and rained upon it stones of baked clay, layered one upon another” (Hūd 11:82).
Thus, Allah combined for them several forms of retribution—total destruction, overturning their homes, sinking them into the earth, and pelting them with stones from the sky—imposing a punishment unmatched by that of any other community, because of the enormity of this crime. -
It is authentically reported that the Prophet (blessings and peace be upon him) said, “Allah has cursed whoever commits the deed of the people of Lot; Allah has cursed whoever commits the deed of the people of Lot; Allah has cursed whoever commits the deed of the people of Lot.” Nowhere is it reported that he pronounced a triple curse upon the fornicator in a single narration.
- Scholarly disagreement
Ibn al-Qayyim stated: Is the prescribed penalty for sodomy harsher than that for adultery, or is adultery the harsher? There are three views:
• Imām Mālik held that the penalty for sodomy is more severe than that for adultery, and this is one narration from Imām al-Shāfiʿī and Imām Aḥmad. The punishment is death, whether the person is the active or the passive partner.
This was also the position of Abū Bakr al-Ṣiddīq, ʿAlī ibn Abī Ṭālib, Khālid ibn al-Walīd, ʿAbd Allah ibn al-Zubayr, ʿAbd Allah ibn ʿAbbās, and Jābir ibn Zayd—may Allah be pleased with them all—though they differed over the specific method of execution.
