1056 – Jābir ibn ʿAbd Allāh (may Allah be pleased with him) narrated: “The Prophet ﷺ stoned to death a man from the tribe of Aslam, a Jewish man, and a woman.” Reported by Muslim (1).
The account of the stoning of the two Jews is found in the two Ṣaḥīḥs through the narration of Ibn ʿUmar (2).
What is drawn from the two ḥadiths:
- The ruling that a muḥṣan adulterer (one who has previously been married) is to be stoned with stones until death is firmly established.
- One admission of guilt by a rational adult makes the ḥadd punishment binding upon him.
- The apparent sense of the ḥadith is that one confession is sufficient, even if it is not repeated four times; the detailed examination of this will follow, God willing.
- A condition for carrying out the ḥadd is the avoidance of injustice, so that the punishment does not spill over to anyone else. If the ḥadd becomes due on a woman who is pregnant, or who later becomes pregnant, she is not to be stoned until she has delivered the child and nursed it the colostrum, for stoning a pregnant woman would harm the fetus. The punishment would then amount to killing someone other than the offender, which is forbidden because it is an assault on an innocent life.
- It is prescribed to fasten a woman’s clothes securely around her when the ḥadd is about to be executed, lest her private parts be exposed.
- It is obligatory to perform the funeral prayer over a person executed by a ḥadd, and the ruler may lead it, just as with the rest of the Muslim dead. The person’s martyr-like status does not cancel the funeral prayer, nor is he among the offenders for whom the prayer is withheld as a deterrent to others—namely, the embezzler of war booty and the one who takes his own life.
