3 – The hadith further shows that when a master enforces the ḥadd on his slave, whether male or female, he must not heap blame, ridicule, or censure upon the offender. Harsh speech is itself a form of discretionary punishment (taʿzīr); combining it with the physical penalty would amount to double chastisement. Rather, he should forgo verbal reproach and hope that Allah, the Exalted, will guide the slave thereby, for rebuking him may only drive him to stubbornness and persistence.
4 – The narration also indicates that a master may discipline his bondwoman twice; if she still fails to desist and remains defiant, this signals an ingrained vice. At that point it is unlawful for him to keep her. He must remove her from his household, even if he must sell her for the lowest price, for retaining a bondwoman who repeatedly commits fornication after being disciplined falls under the heading of dayātha (cuckoldry).
5 – The command to sell a fornicating bondwoman proves that fornication in a female or male slave constitutes a defect that renders the sale subject to annulment. The seller is therefore obliged to inform the purchaser of this defect; if he conceals it, he has deceived the buyer and withheld a material fault.
