1053 – Abu Hurayrah (d. 59 AH) reported: I heard the Messenger of Allah, peace and blessings be upon him, say, “When the slave-girl of any one of you commits fornication and her guilt is confirmed, let him apply the prescribed flogging to her and not reproach her for it. Should she sin again, let him administer the prescribed flogging and not reproach her. Then if she commits it a third time and her guilt is confirmed, let him sell her, even for no more than a rope of hair.” Agreed upon, and this wording is Muslim’s.⦗1⦘
Vocabulary of the ḥadīth
• Zanat: from zanā–yaznī–zinā, meaning illicit sexual intercourse. In the Ḥijāz dialect the final vowel is short (zinā), while in the Najd dialect it is lengthened (zināʾ). Al-Taʿrīfāt defines zināʾ as intercourse in the front passage devoid of both ownership and any legal doubt.
• Al-ama: a female slave.
• Lā yutharrib ʿalayhā: with ḍamma on the yāʾ and a doubled rāʾ. Tharraba–yutharribu–tathrīban means to censure, reproach, or stigmatize someone for a sin. The phrase here means: he must not blame, scold, or harshly rebuke her after she has been purified through the legal punishment.
• Shaʿr (hair): filament-like growth that appears on human skin and on animals. On goats it is called shaʿr (hair), on sheep ṣūf (wool), and on camels wabr (fur).
