Tawḍīḥ al-AḥkāmAbd Allah al-Bassam

Lessons derived from the ḥadith:

  1. The ḥadith indicates that orchard-owners are required to guard their gardens during the day, for they are usually present and working in them, while livestock are customarily let out to graze at that time.

  2. At night the orchard-owners sleep and rest from the day’s toil, and—because their gardens are unfenced—they lie open. Night is not a time for grazing, so the duty of protection shifts to the herders, who must restrain their animals lest they damage other people’s fields while the owners are unaware.

  3. Al-Hiṣnī said in al-Iqnāʿ and its commentary: “The owner of the animals is liable for whatever they destroy of crops, trees, or anything else at night, in accordance with the ḥadith of al-Barāʾ.” Ibn ʿAbd al-Barr added: “Although formally mursal, this ḥadith is well known; trustworthy imams have transmitted it and the jurists of the Ḥijāz have accepted it.” The accepted custom is for herders to release their animals to graze by day and confine them at night, while orchard-owners keep watch over their gardens in daylight. Therefore, if the animals cause damage at night, liability rests with the one in control of them if he was negligent in guarding them. Al-Nawawī said: “The scholars unanimously agree that there is no liability for an animal’s daytime damage unless it is being driven or led, in which case the majority hold the driver liable. As for damage at night, the schools of al-Shāfiʿī and Aḥmad hold the owner responsible.”

  4. In our own times people face a danger greater than orchards: rural highways along which vehicles travel and find livestock standing in the middle of the road. Night-time collisions with these animals lead to multiple fatalities and the loss of innocent lives. Bedouin herders let their animals stray onto these roads; therefore those who are negligent and careless with people’s lives must be dealt with firmly and held accountable.
