Tawḍīḥ al-AḥkāmAbd Allah al-Bassam

1039 – On the authority of Ibn ʿUmar (may Allah be pleased with them) who said: The Messenger of Allah ﷺ stated, “Do you know, O son of Umm ʿAbd, how Allah rules concerning those who rebel from this community?” He replied, “Allah and His Messenger know best.” The Prophet said, “Their wounded are not to be finished off, their captives are not to be killed, their fugitives are not to be pursued, and their fayʾ (confiscated property) is not to be divided.” Reported by al-Bazzār and al-Ḥākim, and al-Ḥākim declared it authentic, but he erred, for the chain contains Kawthar ibn Ḥakīm, who has been abandoned (1). However, a sound mawqūf version from ʿAlī with similar wording has been authenticated through several routes, recorded by Ibn Abī Shaybah and al-Ḥākim (2).

—
Degree of authenticity: The ḥadīth in its marfūʿ form is very weak, yet it is sound as a mawqūf statement of ʿAlī (may Allah honor him).

Ibn Ḥajar said in al-Talkhīṣ: “Al-Ḥākim and al-Bayhaqī narrated it, and al-Ḥākim kept silent about it. Ibn ʿAdī said, ‘This ḥadīth is not preserved,’ and al-Bayhaqī said, ‘It is weak.’” Ibn Ḥajar added, “Its chain contains Kawthar ibn Ḥakīm, and al-Bukhārī said he is abandoned.” End quote.

Thus, the compiler’s remark in Bulūgh al-Marām that “al-Ḥākim declared it authentic” conflicts with what appears in al-Talkhīṣ, namely that al-Ḥākim remained silent about it; indeed, he did remain silent, as found in al-Mustadrak (2/155). That concerns the marfūʿ report, whereas the mawqūf narration from ʿAlī is sound.

Vocabulary of the ḥadīth:
