Tawḍīḥ al-AḥkāmAbd Allah al-Bassam

oaths declaring that they did not kill him and that they do not know who did. If they take the oaths they are exonerated; but if they refuse, the claim is ruled proven against them and the blood money becomes obligatory.

6 – Should the victim’s heirs decline to swear while the defendants do swear, the victim’s blood money is paid from the public treasury so that his blood is not lost. The same applies to anyone killed in the crush of the pilgrimage, or in a mosque, or at a crowded gathering, or simply found dead with no known killer and no evidence pointing to one: in all such cases the compensation comes from the state treasury.

7 – The oath is assigned to whichever of the two parties is the stronger. In a qasāmah claim the oaths are first directed to the victim’s heirs, for their position is reinforced by circumstantial indicators supporting their allegation. When such indicators are strong, they amount to clear evidence. If the heirs refuse to swear, their refusal shifts the advantage to the defendants, who then swear and are cleared of the charge.

8 – It is recommended to give precedence to the eldest in communal affairs, because of the dignity of age, greater devotion, wider experience, and broader expertise.

9 – Acting through an agent is permissible when pursuing the prescribed penal claims (ḥudūd).

10 – Question: Why did the Prophet ﷺ offer the oath to the three men when the only heir among them was ʿAbd al-Raḥmān, and the oath should be directed solely to him? Answer: Once the Prophet ﷺ heard all three relate the manner of the killing and what had occurred, it became unmistakably clear that the substantive claim belonged exclusively to the heir and that the oath pertained to him alone. Yet he addressed them collectively because all three were invested in the matter.

11 – The ḥadith also illustrates the merit of seniority when people are equal in virtue and ability in matters such as leading the prayer, guardianship in marriage, and the like, in view of the elder’s greater experience and earlier service.
