Tawḍīḥ al-AḥkāmAbd Allah al-Bassam

it amounts to half the full blood money, then one third is payable at the end of the first year and the remaining sixth at the end of the second. If he has killed two people—even through a single act—their combined indemnities are to be spread over three years.

9 – The judge must exert himself to levy upon the ʿāqilah an amount each member can readily afford, beginning with the closest agnates and then those next in line. If the estates of the nearest relatives suffice, he does not move beyond them; otherwise he turns to those after them, just as in the laws of inheritance.

10 – Shaykh ʿAbd al-Raḥmān al-Saʿdī said: According to the school, the offender is not obliged to pay any portion of the blood money alongside the ʿāqilah. A second opinion maintains that he must share the payment with them, since they are bearing the liability because of him. This does not contradict the Lawgiver’s placing the indemnity on the ʿāqilah, for their role is one of surety; in origin the liability remains upon the one who inflicted the loss.

11 – Al-Muqniʿ and its marginal commentary state: Whoever has no ʿāqilah—if he is a Muslim, the indemnity comes from the public treasury; if he is not, then under the school’s dominant view nothing is taken from the killer. Another view holds that it should be taken from the killer’s own property, and this is preferable in light of the general wording of Allah’s statement: “and an indemnity must be delivered to his family” (al-Nisāʾ 4:92).

12 – Shaykh Ṣāliḥ al-Ḥuṣayn said: Liability for the ʿaql devolves upon the public treasury in every situation where it cannot be legally established against anyone else and nothing exists to remove it from the treasury.

13 – Shaykh Muḥammad ibn Ibrāhīm Āl al-Shaykh said: The items the public treasury undertakes to pay, whether blood money or debts, are:
First: If a Muslim dies owing a debt, blood money, or the like, and leaves no assets to cover it, the ruler must discharge it from the public treasury, as authenticated hadiths affirm.
Second: When someone commits an offense against another and the offense is accidental or quasi-intentional, and
