1032 – Ibn ʿAbbās (may Allah be pleased with him) said, “During the lifetime of the Messenger of Allah ﷺ a man killed another man, so the Prophet ﷺ set the blood-money at twelve thousand.” The Four compilers narrated it, and both al-Nasaʾī and Abū Ḥātim considered its chain disconnected (mursal). Degree of authenticity:
The hadith is mursal. It is transmitted by the Four, al-Dārimī, al-Dāraquṭnī, and al-Bayhaqī through the route of ʿAmr ibn Dīnār from ʿIkrimah from Ibn ʿAbbās, and al-Nasaʾī as well as Abū Ḥātim preferred the judgment that it is mursal. It has also been reported as a statement halted at Ibn ʿAbbās: Ibn Abī Shaybah recorded it via Muḥammad ibn Isḥāq, who said, “ʿAbd al-Raḥmān ibn Abī Zayd related to me from Nāfiʿ ibn Jubayr from Ibn ʿAbbās.” I say: this isnād is weak; its flaw is ʿAbd al-Raḥmān, the son of al-Baylamānī, and he is weak, as stated in the works of criticism and validation.
Points derived from the hadith:
- The earlier discussion has shown that the types of diyah are five: camels, cattle, sheep, gold, and silver. Some scholars regard all five as original forms of the diyah, and this is the well-known position in the school of Imām Aḥmad.
- Others hold that camels alone are the original form and that the remaining items are substitutes; this is the stronger view, and its evidences have already been detailed.
- This hadith shows that the Prophet ﷺ paid the diyah in silver—twelve thousand
