1030 – ʿAmr ibn Shuʿayb, from his father, from his grandfather, reported that the Messenger of Allah ﷺ said: “The indemnity of the protected non-Muslims is one-half the indemnity of the Muslims.” It was narrated by Aḥmad and the Four.
Abū Dāwūd’s wording is: “The blood-money of a treaty-holder is half that of a free Muslim.”
Al-Nasāʾī has the variation: “A woman’s indemnity is the same as a man’s until it reaches one-third of her full blood-money.” Ibn Khuzaymah declared it authentic (1).
Degree of authenticity:
The ḥadith is classified as ḥasan (sound).
It was recorded by Aḥmad, Abū Dāwūd, al-Nasāʾī, al-Tirmidhī, Ibn Mājah, and al-Bayhaqī through the chain of ʿAmr ibn Shuʿayb from his father from his grandfather.
Al-Tirmidhī said: “A ḥasan ḥadith,” and Ibn Khuzaymah authenticated it.
The chain is deemed sound despite the well-known scholarly debate over the narrations of ʿAmr ibn Shuʿayb from his father from his grandfather.
The ḥadith also has a supporting report in al-Ṭabarānī’s al-Awsat.
Al-Albānī commented: “The version in al-Nasāʾī concerning a woman’s indemnity is weak for two reasons: (1) Ibn Jurayj relates it with an unspecified link (ʿanʿanah) and he was a mudallis, and (2) Ismāʿīl ibn ʿAyyāsh is weak.”
