As for the precise form of this aggravated diyah according to the three Imams—Abū Ḥanīfah, Mālik, and Aḥmad—and a number of the early scholars, it is what is reported from Ibn Masʿūd: that it is divided into four equal parts—“twenty-five bint makhāḍ, twenty-five bint labūn, twenty-five ḥiqqah, and twenty-five jadhʿah.”
The same report is also transmitted from al-Sāʾib ibn Yazīd—may Allah be pleased with him—as a ḥadith traced back to the Prophet. -
The diyah for semi-intentional homicide is like that for accidental homicide in that it is payable by the killer’s ʿāqilah (his male agnate relatives). This is based on the report found in the two Ṣaḥīḥs from Abū Hurayrah who said: “Two women from the tribe of Hudhayl fought, and one of them threw a stone at the other, killing her and the child in her womb. The Prophet—may Allah bless him and grant him peace—ruled that the diyah for her unborn child is a male or female slave, and that the diyah for the woman be borne by her ʿāqilah.”
