1024 – Ibn Masʿūd (may Allah be pleased with him) reported that the Prophet ﷺ said: “The diyah for an unintentional killing is paid in five equal parts: twenty ḥiqqah, twenty jadhʿah, twenty banāt makhāḍ, twenty banāt labūn, and twenty banū labūn.” Al-Dāraqutnī recorded it.
The Four Sunan also transmitted the report with the wording “and twenty banū makhāḍ” instead of “banū labūn.”
The first chain is stronger. Ibn Abī Shaybah narrated it through another route as a mawqūf report, and that version is more sound than the marfūʿ one (1).
Abū Dāwūd and al-Tirmidhī likewise collected—through the isnād of ʿAmr ibn Shuʿayb, from his father, from his grandfather—a marfūʿ report: “The diyah is thirty ḥiqqah, thirty jadhʿah, and forty khuluf carrying their unborn young” (2).
