Tawḍīḥ al-AḥkāmAbd Allah al-Bassam

1023 – Abu Bakr ibn Muhammad ibn ʿAmr ibn Hazm narrated—through his father, from his grandfather—that the Prophet ﷺ wrote to the people of Yemen, mentioning in that letter:

“Whoever deliberately kills a believer without right, after the evidence has been established, is subject to retaliation (qiṣāṣ), unless the heirs of the slain are content. For the taking of a life, the diya is one hundred camels; for the nose, when it is completely severed, the full diya; for the tongue, the full diya; for the two lips, the full diya; for the penis, the full diya; for the two testicles, the full diya; for the backbone, the full diya; for one leg, half the diya. For a maʾmūmah (a head wound that reaches the membrane), one-third of the diya; for a jāʾifah (a penetrating wound of the body cavity), one-third of the diya; for a munqilah (a displaced fracture), fifteen camels. For every finger of the hand or the foot, ten camels; for a tooth, five camels; for a muḍiḥah (a wound that exposes the bone), five camels. A man is put to death for [murdering] a woman, and for people who deal in gold the full diya is one thousand dinars.”

It was recorded by Abū Dāwūd in al-Marāsīl, as well as by al-Nasāʾī, Ibn Khuzaymah, Ibn al-Jārūd, Ibn Ḥibbān, and Aḥmad, though they disagreed over its authenticity.⦗1⦘

Hadith grading:
The hadith is sound, and the discussion of it has already appeared in the Book of Purification. Nonetheless, the hadith specialists differed about its authenticity, for Abū Dāwūd said, “It has been transmitted as a musnad …”
