and is then appraised once more while the wound is present. Whatever gap exists between the two valuations is calculated against the full blood-money of a free person; that figure becomes the monetary compensation (arsh) for the injury.
- a-tuksaru: the initial hamza marks a rhetorical question. Anas was not denying the ruling itself; he spoke under the sway of anger and tribal zeal, or because he was unaware of the legal ruling.
- Kitābu Allāhi al-qiṣāṣ: subject and predicate, meaning: the Book of Allah rules for retaliation.
- la-abirrah: the prefixed lām adds emphasis in response to an oath; that is, Allah will not let the swearer fall into perjury. Rather, He fulfils the oath, grants what was sworn for, and honours the swearer, knowing him to be one of His righteous servants.
- Lessons derived from the hadith:
Allah the Exalted says, “and a tooth for a tooth” (al-Maʾidah 45). Al-Rubayyiʿ bint al-Naḍr, sister of Anas ibn al-Naḍr—one of the martyrs of ʿUhud—and paternal aunt of Anas ibn Mālik, the Prophet’s attendant, intentionally broke the incisor of one of the Ansari girls. Anas ibn al-Naḍr asked the girl’s guardians to pardon his sister, but they refused. They then offered them the blood-money, yet they still refused and took the matter to the Prophet ﷺ, demanding retaliation and insisting upon it. The Prophet ﷺ therefore ordered retaliation. Anas ibn al-Naḍr said, “Messenger of Allah, will al-Rubayyiʿ’s incisor really be broken? By the One Who sent you with the truth, her tooth will not be broken!” The Prophet ﷺ replied, “O Anas, it is the Book of Allah.” The people were then satisfied and forgave, whereupon the Messenger of Allah ﷺ said, “Among Allah’s servants are those who, were they to swear by Allah, He would surely fulfil their oath.”
This hadith contains a number of meanings and rulings, including:
1 – The validity of retaliation for a tooth, as Allah says, “and a tooth for a tooth” (al-Maʾidah 45). Retaliation is applicable only in cases of deliberate assault; in accidental or quasi-deliberate cases there is only the blood-money.
2 – Retaliation must be carried out with a tooth equivalent to the one that was injured.
