- yuṭallu: with a ḍamma on the yāʾ, a fatḥa on the ṭāʾ, and a doubled lām; it means that the victim’s blood is rendered void—no retaliation is taken and no blood money is collected.
- al-kuhhān (soothsayers): plural of kāhin. A kāhin is anyone who claims knowledge of the unseen or professes to unveil hidden matters—whether a fortune-teller, astrologer, geomancer, or the like.
- sajʿuhu: sajʿ (rhyme-prose) is a rhetorical device defined by the scholars of eloquence as the agreement of prose endings in consonant or in both consonant and rhythm. Soothsayers are adept at this rhyme-prose and use it profusely to deceive people.
- ʿalā ʿāqilatihā: the pronoun refers to the female offender.
Lessons derived from the ḥadith
- Two co-wives from the tribe of Hudhayl quarreled; one hurled a small stone at the other—a projectile that normally does not kill—but it caused her death and that of the fetus in her womb. The Prophet ﷺ ruled that the fetus’s diyah is a ghurrah—a male or female slave—payable by the assailant, and that the slain woman’s blood money is due because her killing was quasi-intentional (shibh ʿamd). That blood money is to be borne by her ʿāqilah, for the very purpose of the ʿāqilah is mutual support, and because the killing was not deliberate.
- This ḥadith is the foundational proof for the second category of homicide, shibh ʿamd (quasi-intentional killing): the perpetrator intends the assault with something that ordinarily does not kill, such as a small stone or light stick. The ruling for this type is that the diyah is aggravated against the killer, while no retaliation (qiṣāṣ) is taken.
- The diyah for shibh ʿamd—and likewise for manslaughter (khaṭaʾ)—is paid by the killer’s ʿāqilah: the male agnates among his relatives, near and distant, even if they are not heirs. Because agnatic support is based on solidarity, and this calamity occurred unintentionally, their assistance is fitting even if the killer is wealthy. The burden is eased by distributing the payment among them according to degree of kinship, and it is scheduled in installments over three years.
