- Points derived from the ḥadith:
1 – The ḥadith establishes the basic ruling of qiṣāṣ (legal retaliation) by execution in cases of deliberate, hostile murder.
2 – It shows that a man is subject to retribution for killing a woman—and, a fortiori, a woman for killing a man.
3 – It reveals the covetousness and greed of the Jews, for the murderer killed her only for “some silver ornaments of hers,” as one wording of the report states.
4 – It testifies to their cruelty, malice, and treachery: though this treaty-bound Jew could have seized the ornaments without resorting to such a heinous slaying, his vileness and rancor toward the Muslims led him to commit the outrage.
5 – The ḥadith is cited as evidence for the ruling on killing the perpetrator of ghīlah (treacherous murder carried out by deception), for the Prophet ﷺ executed the Jew without any request from the girl’s guardians, as will be detailed, God willing.
6 – It indicates that the killer is executed in the same manner by which he killed—whether with a blunt instrument or a sharp one. The scholars differ on this:
• The majority, including the three leading imāms, and Ibn Taymiyyah, hold that the offender is executed just as he killed: if with a heavy object, then with a heavy object; if with something sharp, then with something sharp. Their proofs are the verse, “But if you retaliate, retaliate with the like of that with which you were afflicted” (16:126), and this explicit, sound ḥadith. This is also one report in the school of Aḥmad.
• Imām Aḥmad, however, in the well-known position of his school, ruled that retribution may be taken only with a cutting tool such as a sword or knife, citing the report in Ṣaḥīḥ Muslim (1955): “When you kill, then kill well, and let one of you sharpen his blade.”
