Tawḍīḥ al-AḥkāmAbd Allah al-Bassam

Lessons derived from the two ḥadiths

  1. Both reports make it unequivocally unlawful for a man to be alone with a non-maḥram woman—i.e., any woman with whom marriage remains permissible. In another narration it is stated: “Whenever a man is secluded with a woman, Satan is the third among them.”
  2. The gravity of this matter is beyond doubt. When the Messenger of Allah ﷺ was asked about a husband’s male in-laws—such as his brother, cousin, and the like—being alone with his wife, he replied: “The in-law is death.” The reason is that such a relative may enter the house and be in seclusion unchecked, and the very outcome the Law came to prevent may then occur.
  3. Womanhood is, by its very nature, a locus of desire and temptation, and a woman is seldom able to protect herself because of her physical and social vulnerability. No one guards her honor as do her maḥram relatives, who regard any violation of her dignity as an affront to their own. For this reason the Law insists that a maḥram be present whenever a stranger approaches.
  4. Likewise, even a pious man, when alone with a non-maḥram woman, is exposed to temptation, to Satan’s enticement, and to the whisperings of a soul prone to evil. Hence the Sacred Law treated this issue with the utmost strictness and allowed no laxity in it.
  5. In our times people have grown negligent, granting women free rein with drivers, cooks, and similar employees. Besides the inherent sin, this poses a serious threat to honor and chastity—and safeguarding one’s honor is among the five necessities the Law came to preserve. Allah alone is the One sought for help.

Definition of khalwah (seclusion)
Lexicographers say: khala al-shayʾ yakhlū khalwatan—“the thing became empty,” so it is khālī (vacant).
Al-khalāʾ denotes an empty place in which nothing is found.
One also says: khalā al-makān wa’l-shayʾ khalwan, “the place or the object was devoid of occupants.” Likewise, khalā al-rajul bi-ṣāḥibihi, ilayhi, or maʿahu means “the man gathered with his companion, went apart with him, or met him in private.” Allah, Exalted is He, says: “But when they retire privately to their devils, they say, ‘We are truly with you’” (al-Baqarah 2:14).
