5 – As for a child who has reached the age of discernment, he is not charged with the commands and prohibitions that bind adults. Yet with regard to divorce, the discerning minor knows that if he divorces his wife she becomes separated from him and unlawful to him. His divorce is therefore acknowledged and takes effect, for it issues from a rational person; it is valid just like the divorce of an adult, in which matter he possesses full legal capacity.
