927 – Ibn ʿAbbās (may Allah be pleased with them both) related: “The wife of Thābit ibn Qays came to the Prophet ﷺ and said, ‘Messenger of Allah, I do not fault Thābit ibn Qays in character or in religion, but I dislike falling into unbelief after having embraced Islam.’ The Messenger of Allah ﷺ asked, ‘Will you return his garden to him?’ She replied, ‘Yes.’ He said, ‘Accept the garden and divorce her with a single pronouncement.’ ” Recorded by al-Bukhārī.
In another wording recorded by him: “and he instructed him to divorce her.”
Abū Dāwūd and al-Tirmidhī—who graded it sound (ḥasan)—narrated: “The wife of Thābit ibn Qays sought khulʿ from him, so the Prophet ﷺ set her waiting period at one menstrual cycle.” (1)
In the narration of ʿAmr ibn Shuʿayb, from his father, from his grandfather (may Allah be pleased with him), recorded by Ibn Mājah: “Thābit ibn Qays was unpleasant in appearance, and his wife said, ‘Were it not for fear of Allah, when he entered upon me I would have spat in his face.’” (2)
Aḥmad records, from the report of Sahl ibn Abī Ḥathmah: “That was the first khulʿ in Islam.” (3)
