874 – ʿAmr ibn Shuʿayb, from his father, from his grandfather (may Allah be pleased with him), reported that “the Prophet ﷺ restored his daughter Zaynab to Abū al-ʿĀṣ on the basis of a new marriage contract.” Al-Tirmidhī remarked, “The report of Ibn ʿAbbās has the stronger chain, yet legal practice has followed the report of ʿAmr ibn Shuʿayb.” (1)
Hadith grading
This ḥadīth is weak.
It was recorded by al-Tirmidhī, Ibn Mājah, and al-Ṭaḥāwī through the route of ʿAmr ibn Shuʿayb, from his father, from his grandfather. The chain is weak and its defect lies with al-Ḥajjāj, for he was a mudallis (a transmitter who concealed his sources).
ʿAbd Allāh ibn Aḥmad said: “My father declared, ‘This ḥadīth is weak. Al-Ḥajjāj did not hear it from ʿAmr ibn Shuʿayb; rather he took it from Muḥammad ibn ʿUbayd Allāh al-ʿArzamī, whose narrations are worthless. The sound report is that the Prophet ﷺ left the couple upon their first marriage.’”
Al-Bayhaqī and al-Dāraquṭnī said, “This ḥadīth is not established; al-Ḥajjāj is not relied upon. The correct narration is that of Ibn ʿAbbās.”
Al-Bukhārī stated, “The ḥadīth of Ibn ʿAbbās is better and more authentic.”
The report of ʿAmr ibn Shuʿayb was judged weak by al-Tirmidhī, al-Khaṭṭābī, al-Bayhaqī, and Majd Ibn Taymiyyah.
