—and likewise arranging the marriage of a male fornicator is forbidden until he repents.
6 – Nayl al-Maʾārib states: “The fornicatress is forbidden—whether to a fornicator or to anyone else—until she repents and her waiting period has elapsed.”
Shaykh Muḥammad ibn Ibrāhīm said: A man may not marry a woman who is pregnant from his own act of fornication until she completes her waiting period by delivering the child.
Shaykh al-Islām declared: “Marrying a fornicatress is unlawful until she repents, whether he himself fornicated with her or someone else did. This is unquestionably the correct view. It is held by a number of early and later scholars, among them Aḥmad ibn Ḥanbal and others, and it is supported by the Quran, the Sunnah, and sound reason.”
If a woman persists in fornication, the husband is not permitted to keep her in that state; he must separate from her, otherwise he is a dayyūth (a cuckold who tolerates immorality), for the two sources are opposed—impurity versus purity, wholesomeness versus foulness—and the two acts of intercourse differ, one lawful and the other forbidden.
