Hadith grading
This hadith is ṣaḥīḥ (sound).
Al-Albānī said: “Ibn Mājah, al-Dāraqutnī, and al-Bayhaqī transmitted it through the chain of Jamīl ibn al-Ḥasan al-ʿAtakī: ‘Muḥammad ibn Marwān al-ʿUqaylī told us, Hishām ibn Ḥassān narrated to us, from Muḥammad ibn Sīrīn, from Abū Hurayrah.’
This isnād is ḥasan; all of its transmitters are reliable except Muḥammad ibn Marwān.
Al-Ḥāfiẓ said: ‘He is truthful but prone to mistakes.’
I add: he has been corroborated by another chain whose narrators are trustworthy, as Ibn Daqīq al-ʿĪd noted, and the hadith was authenticated by al-Suyūṭī.
Points derived from the hadith
- It is prohibited to arrange the marriage of a previously-married woman without first consulting her and obtaining her explicit consent. The prohibition is phrased as a negation for greater emphasis, indicating that a marriage contract concluded without her approval is invalid.
- It is likewise forbidden to marry off a virgin before seeking her permission. Because her consent is required, a marriage conducted without it is also invalid.
- The requirement to seek her permission shows that the hadith concerns a mature girl who understands the implications of marriage and the identity of the prospective husband
