- It is prohibited for anyone who has heirs to bequeath more than one-third of his estate, or to make a bequest in favor of an heir, unless the heirs themselves approve.
- It is recommended for someone who leaves considerable wealth to bequeath up to one-third or less.
- It is disliked for a poor person whose heirs are in need.
- It is permissible for a poor person if his heirs are well-off.
٢ - تحرم على من له وارث، إذا وصَّى بأكثر من الثلث، أو وصَّى لوارث بشيءٍ، ما لم تُجز الورثة.
٣ - تسن لمن ترك خيرًا كثيرًا بالثلث فأقل.
٤ - تكره لفقير، وارثه محتاج.
٥ - تباح لفقير إن كان ورثته أغنياء.
