825 – Jābir (may Allah be pleased with him) narrated that the Prophet (peace and blessings be upon him) said: “If the newborn cries aloud, he inherits.” Reported by Abū Dāwūd and declared authentic by Ibn Ḥibbān. (1)
— Grading of the ḥadīth:
The ḥadīth of this chapter is ṣaḥīḥ (authentic). Al-Ḥākim judged it sound and al-Dhahabī concurred. It also has a corroborating narration from Abū Hurayrah. Ibn ʿAbd al-Hādī said in al-Muḥarrar, “Its chain is good.”
Abū Dāwūd recorded it, as did al-Bayhaqī through his transmission, and Ibn Ḥibbān authenticated it. All the transmitters in its isnād are trustworthy except that it contains Ibn Isḥāq, who was a mudallis and related it by ʿanʿanah. Nonetheless, it has additional routes through Abū Hurayrah and further supporting reports that increase its strength.
First corroborating report: from Ibn ʿAbbās, but its chain is weak.
Second corroborating report: from Makḥūl, who said, “The Messenger of Allah (peace and blessings be upon him) said …,” narrating it mursal; its mursal chain is sound.
— Lexical notes:
• “istahalla al-mawlūd”: when the infant raises his voice in crying and wails at birth; istihlāl means raising the voice.
• “waritha” (he inherited), with a fatḥa on the wāw and a kasra on the rāʾ. Linguistically, irth (inheritance) denotes continuance; thus wārith (heir) is “the one who remains.” In Islamic law it refers to “a right established for an eligible person upon the death of the one from whom that right derives, by reason of kinship or the like.”
