821 – ʿImrān ibn Ḥuṣayn reported: “A man came to the Prophet ﷺ and said, ‘The son of my son has died; what share of his estate do I receive?’ He replied, ‘You are entitled to one-sixth.’ When the man turned to leave, the Prophet ﷺ called him back and said, ‘You have another one-sixth.’ When he turned away again, the Prophet ﷺ called him back and said, ‘That other sixth is ṭuʿmah, a discretionary allotment.’ ”
Reported by Aḥmad and the Four Sunan compilers; al-Tirmidhī declared it sound. The report comes through al-Ḥasan al-Baṣrī from ʿImrān, although some scholars say al-Ḥasan never heard directly from him.⦗1⦘
Grading of the ḥadith
The report is ḥasan (good). It was narrated by Imām Aḥmad and the Four, and al-Tirmidhī judged it ṣaḥīḥ (sound). It is transmitted through al-Ḥasan al-Baṣrī from ʿImrān ibn Ḥuṣayn, though there is disagreement about a direct meeting between the two. In Bulūgh al-Amānī it is cited that al-Tirmidhī said, “This ḥadith is ḥasan ṣaḥīḥ.”
Vocabulary
• Ṭuʿmah: pronounced with a ḍamma on the ṭā and a sukūn on the ʿayn; plural ṭuʿam. It means sustenance, provision. Al-Nihāyah explains, “The other sixth is ṭuʿmah,” that is, an extra portion over and above his legal share.
