818 – Usāmah ibn Zayd (may Allah be pleased with him) reported that the Prophet ﷺ said, “A Muslim does not inherit from an unbeliever, and an unbeliever does not inherit from a Muslim.” Agreed upon. (1)
819 – ʿAbd Allāh ibn ʿAmr (may Allah be pleased with him) said: The Messenger of Allah ﷺ declared, “The followers of two different religions do not inherit from one another.” It was narrated by Ahmad and the Four, except for al-Tirmidhī; (2) al-Ḥākim also recorded it with the wording found in Usāmah’s report, (3) and al-Nasāʾī transmitted Usāmah’s ḥadith in this very wording. Hadith grading (811)
The chain of this ḥadith is sound. It was collected by Imām Ahmad, Abū Dāwūd, al-Nasāʾī, Ibn Mājah, and others, while its root wording appears in the two Ṣaḥīḥs from the marfūʿ report of Usāmah ibn Zayd: “An unbeliever does not inherit from a Muslim, nor a Muslim from an unbeliever.” It is further supported by the following corroborations:
1 – The ḥadith of ʿAmr ibn Shuʿayb, from his father, from his grandfather, as marfūʿ: “The followers of two distinct religions do not inherit from one another.” Abū Dāwūd, Ibn al-Jārūd, al-Dāraqutnī, and Ahmad related it through the line of ʿAmr, and its chain is ḥasan (good).
2 – The ḥadith of Jābir, which al-Dāraqutnī recorded in a mawqūf form and said, “This is the preserved version,” while Sharik narrated it from al-Ashʿath, from al-Ḥasan, from Jābir as a marfūʿ report.
Al-Sāʿātī stated in al-Fatḥ al-Rabbānī: its chain is good.
